1. General Provisions

These Terms and Conditions, hereinafter referred to as the “Terms,” govern access to and use of the G4MAX website, mobile application, administrative tools, features, services and other digital infrastructure, collectively referred to as the “Platform.”

By using the Platform, viewing properties, creating an account, publishing information, submitting a request, accessing contact details or using any other G4MAX feature, you confirm that you have read, understood and agreed to these Terms.

If you do not agree to these Terms, you must stop using the Platform.

2. Definitions

For the purposes of these Terms:

G4MAX, “we,” “us” or “our” means the owner and/or operator of the G4MAX Platform.

User means any individual or legal entity that visits or uses the Platform.

Registered User means a User who has created an account on the Platform.

Property Owner means an owner, tenant, manager, representative or other person legally authorised to publish information about a Property and make arrangements regarding its use.

Property means a house, apartment, villa, cottage, sauna, country complex, event space or other location intended for recreation, entertainment, accommodation or events.

Listing means a Property page that may contain descriptions, photographs, characteristics, prices, rules, location details, contact information and other information.

Request means an enquiry, application or other action intended to establish contact with a Property Owner.

User Content means photographs, videos, texts, descriptions, reviews, contact information and other materials submitted or published by a User.

3. Status of G4MAX

G4MAX is an information and technology platform that helps Users find and view Properties for recreation, entertainment, accommodation and events and contact their owners or representatives.

Unless expressly stated otherwise on the Platform, G4MAX is not:

  • the owner or landlord of any Property;

  • a hotel or accommodation provider;

  • a tour operator or travel agent;

  • a real estate agency;

  • a party to any rental, booking or service agreement;

  • a payment organisation or financial institution;

  • an insurer or guarantor of arrangements between Users.

G4MAX provides digital tools for finding information and establishing contact. All arrangements regarding prices, availability, bookings, payments, property rules, cancellations, refunds and other conditions are made directly between Users.

4. Eligibility

The Platform may be used by persons who have the legal capacity required under applicable law.

A person under the age of 18 may use the Platform only with the participation and under the responsibility of a parent, guardian or other legal representative.

By using the Platform, you confirm that you:

  • provide accurate and up-to-date information;

  • have the legal right to perform the relevant actions;

  • will not use the Platform for unlawful or fraudulent purposes;

  • will comply with these Terms and applicable law.

5. Registration and Account Security

An account may be required to access certain Platform features.

During registration, G4MAX may request a name, telephone number, email address, verification code and other information necessary for the operation of the Platform.

The User must:

  • provide accurate information;

  • keep account information up to date;

  • not create an account on behalf of another person without permission;

  • not provide third parties with access to the account;

  • protect verification codes and access credentials;

  • immediately notify G4MAX of any suspected unauthorised access.

The User is responsible for actions performed through their account, except where such actions result from circumstances for which G4MAX is legally responsible.

6. Property Listings

Listings may be created by a Property Owner, an authorised representative or the G4MAX administration using lawfully obtained information.

A person submitting information about a Property confirms that:

  • they have the right to list the Property;

  • they have the necessary permission from the owner or authorised representative;

  • descriptions, photographs, prices and characteristics are accurate;

  • the use of the Property does not violate applicable law or third-party rights;

  • contact information may be used for communications relating to the Property.

G4MAX may, at its discretion:

  • create and format Property pages;

  • correct errors and format information;

  • change categories, characteristics and display order;

  • request supporting documents or clarification;

  • reject publication;

  • temporarily hide or remove a Listing;

  • restrict the visibility of contact information.

Publication of a Listing does not mean that G4MAX has verified ownership, the identity of the Property Owner, the quality, safety or actual condition of the Property.

7. User Content

The User is responsible for all User Content submitted, uploaded or published on the Platform.

By submitting User Content, you confirm that:

  • you have the right to use and submit the relevant materials;

  • the materials do not infringe copyright, property, privacy or other third-party rights;

  • the materials do not contain unlawful, misleading or prohibited information;

  • all persons appearing in photographs or videos have provided any legally required consent.

The User grants G4MAX a non-exclusive, royalty-free and worldwide licence to store, copy, technically process, format, translate, publish and display User Content for the purposes of:

  • operating the Platform;

  • displaying and promoting the relevant Property;

  • advertising G4MAX and its features;

  • publishing materials on the website, application and official G4MAX social media accounts.

This licence remains valid while the User Content is published on the Platform and for the period technically necessary after deletion, including for backup purposes.

8. Requests, Bookings and Arrangements

A User may contact a Property Owner by opening a telephone number, submitting a Request, using a messenger link, selecting a contact button or using another available feature.

Submitting a Request through G4MAX does not itself confirm a booking and does not require the Property Owner to provide the Property.

Before entering into any arrangement, Users should independently agree on:

  • the exact address and characteristics of the Property;

  • arrival and departure dates and times;

  • the full price;

  • the amount and payment procedure for any deposit or advance payment;

  • cancellation and refund conditions;

  • the number of guests;

  • additional services;

  • conduct rules and responsibility for damage;

  • the procedure for receiving keys or accessing the Property.

G4MAX does not guarantee that a Property will be available on a particular date or that arrangements between Users will be performed.

9. User Contact Information

Certain contact details may be available only to Registered Users after an active action, such as selecting “Show number,” “Contact” or “Request.”

Contact information obtained through G4MAX may be used only for communications relating to the relevant Property.

Such information must not be used for:

  • spam or mass messaging;

  • unrelated advertising;

  • creating contact databases;

  • transfer or sale to third parties;

  • harassment, threats or abuse;

  • fraud;

  • any purpose unrelated to the Property.

10. Payments

As of the effective date of these Terms, G4MAX does not accept rental payments, process payment cards, store payment details, hold deposits or issue refunds between Users.

Any payments, advance payments, deposits or refunds are made directly between Users outside the Platform and at their own risk.

G4MAX is not responsible for:

  • payments sent to the wrong person;

  • fraudulent payment details;

  • failure to return an advance payment or deposit;

  • booking cancellations;

  • disputes regarding prices or services.

If G4MAX introduces payments, commissions, subscriptions or paid services in the future, the relevant terms will be published before such functionality becomes available.

11. User Responsibilities and Safety

Users independently assess the appropriateness and safety of interactions with other Users.

Before making a payment or visiting a Property, Users should:

  • verify the identity of the Property Owner or representative;

  • verify their authority to offer the Property;

  • confirm the address, photographs, conditions and current price;

  • retain correspondence and evidence of arrangements;

  • never provide passwords, SMS codes or full payment card details;

  • avoid making payments through suspicious links;

  • comply with fire, sanitary and personal safety rules.

Each User is independently responsible for their conduct, guests, children, pets, personal belongings and compliance with Property rules.

12. Prohibited Use

Users must not:

  • violate applicable law or third-party rights;

  • create fake accounts or Listings;

  • impersonate another person;

  • publish false or misleading information;

  • publish another person’s personal data without a lawful basis;

  • engage in fraudulent activity;

  • use the Platform for unlawful events or services;

  • send threatening, abusive or discriminatory messages;

  • upload viruses or malicious code;

  • interfere with the operation of the Platform;

  • attempt to gain unauthorised access to accounts or systems;

  • use bots, scrapers, scripts or other automated tools without written permission from G4MAX;

  • copy the Property database or substantial parts of the Platform;

  • collect User contact information;

  • circumvent technical or security restrictions.

13. Moderation

G4MAX has the right, but not the obligation, to review Listings, accounts, photographs, descriptions, complaints and other activity on the Platform.

Without prior notice, G4MAX may:

  • edit or reject materials;

  • hide or remove a Listing;

  • restrict access to certain features;

  • request additional documents;

  • temporarily or permanently suspend an account;

  • retain information concerning violations;

  • disclose information to competent authorities where required or permitted by law.

Moderation does not constitute full verification of every Property or a guarantee that every interaction will be safe.

14. G4MAX Intellectual Property

The software code, design, structure, logo, name, graphic elements, texts, databases, interfaces and other G4MAX materials are owned by G4MAX or used under a lawful licence.

Without prior written permission from G4MAX, Users must not:

  • copy or reproduce the Platform;

  • use the G4MAX logo or brand;

  • copy the Property database;

  • reverse engineer the Platform;

  • create derivative services based on the Platform;

  • use G4MAX materials for commercial purposes.

15. Third-Party Services and Links

The Platform may use or contain links to third-party services, including maps, messengers, SMS providers, analytics providers, hosting services, photo storage services and social networks.

G4MAX does not control third-party services and is not responsible for their content, availability, security, terms of use or privacy policies.

16. Platform Availability and Changes

The Platform is provided on an “as is” and “as available” basis.

G4MAX does not guarantee continuous, permanent or error-free operation of the Platform.

We may at any time:

  • change the design and functionality;

  • add or remove features;

  • introduce limitations;

  • carry out maintenance;

  • temporarily or permanently discontinue parts of the Platform.

17. Account Suspension and Deletion

G4MAX may restrict or suspend a User’s access if the User:

  • violates these Terms;

  • provides false information;

  • creates a risk to other Users or the Platform;

  • engages in fraudulent or unlawful activity;

  • misuses contact information;

  • infringes third-party rights;

  • attempts to circumvent a previous suspension.

A User may stop using the Platform and request account deletion through the account deletion feature, the Account Deletion Info page or by contacting support@g4max.com.

Certain information may be retained after account deletion where necessary to comply with legal obligations, protect security, prevent fraud, resolve disputes or protect the legitimate interests of G4MAX and other persons.

18. Disclaimer of Warranties

To the extent permitted by applicable law, G4MAX does not guarantee:

  • the accuracy, completeness or current status of all Listings;

  • the identity of every User;

  • a User’s authority to offer a Property;

  • that photographs reflect the actual condition of a Property;

  • the quality, cleanliness, safety or legality of a Property;

  • availability of a Property on a required date;

  • that prices and conditions will not change;

  • that Users will act in good faith;

  • successful conclusion or performance of any arrangement.

19. Limitation of Liability

To the maximum extent permitted by law, G4MAX is not liable for:

  • the actions or omissions of Users;

  • the quality, condition or safety of Properties;

  • errors or false information in Listings;

  • booking cancellations;

  • changes to prices or conditions;

  • loss of or damage to property;

  • fraud by third parties;

  • payments, advance payments, deposits or refunds;

  • indirect losses, loss of profit or loss of opportunity;

  • technical errors, loss of data or Platform unavailability;

  • the use of third-party websites or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by law, a User who lists a Property or uses the Platform in connection with commercial or professional activity agrees to compensate G4MAX for documented losses, expenses and third-party claims arising from:

  • a violation of these Terms;

  • the publication of unlawful or false User Content;

  • infringement of third-party rights;

  • unlawful use of personal or contact information;

  • fraudulent or other unlawful actions by that User.

21. Privacy

The collection, use, storage and other processing of personal data are governed by the G4MAX Privacy Policy, which forms an integral part of the rules governing use of the Platform.

By using the Platform, the User confirms that they have reviewed the Privacy Policy.

22. Changes to These Terms

G4MAX may update these Terms from time to time.

The current version will be published on the Platform together with its version number and effective date.

Where changes are material, G4MAX may notify Users through the application, email, push notification or another available channel.

Continued use of the Platform after the updated Terms take effect constitutes acceptance of the changes.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ukraine, except where mandatory provisions of the law of the User’s country of residence require otherwise.

Before commencing court proceedings, the parties should, where reasonably possible, attempt to resolve the dispute through negotiations.

A written complaint may be submitted to support@g4max.com. The complaint should include contact information, a description of the circumstances, the requested resolution and any available supporting materials.

If the dispute cannot be resolved through negotiations, it will be considered by a competent court in accordance with applicable law.

24. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Failure by G4MAX to exercise any right does not constitute a waiver of that right.

G4MAX may transfer its rights and obligations to another operator or legal successor to the extent permitted by applicable law.

The Ukrainian and English versions of these Terms have the same structure. In the event of any inconsistency, the Ukrainian version will prevail unless otherwise required by applicable law.
